Can AI or Google Draft Your Contracts?

It is easy to find a contract template online. It is even easier to ask ChatGPT to write one for you. But when the document ends up being unenforceable or worse, exposes your business to legal and financial risk, that shortcut becomes a liability. The tools are convenient, but they do not replace the precision or legal insight that is provided by legal counsel.

Here is why relying on AI or Google to draft your contracts could cost you more than you save.

  1. Templates Are Not Tailored to Florida Law

Online templates and AI-generated contracts are not state-specific by default. Florida has unique requirements for certain contract types, including non-compete agreements, real estate agreements, and indemnity provisions. For example, Florida courts require specific language in indemnification clauses to make them enforceable in certain industries. If your contract does not comply with state law, a court may throw it out entirely.

An AI platform does not know if your contract needs to comply with Chapter 607 (Florida Business Corporation Act) or Chapter 605 (Florida Revised LLC Act). That distinction matters, and so do the consequences when the wrong provisions are used in drafting.

  1. Missing or Misused Legal Terms

AI-generated content often includes standard language, but AI does not understand the legal meaning of what it is producing. It may use words like “shall,” “may,” or “material breach” inconsistently or incorrectly. In contract law, one word can change the outcome of a dispute.

Without a clear understanding of how the terms interact, you may end up with a document that contradicts itself or gives the other party more rights than you intended.

  1. No Context for Business Goals or Risk

Your contract should reflect your business’s risk tolerance and operational goals. AI does not understand your industry, your partnerships, or the structure of your Florida entity. It can not advise you whether an arbitration clause makes sense or if you should include a personal guarantee.

A lawyer’s role is not just drafting a document, it is asking the right questions to make sure the contract supports your broader business strategy and protects your business.

  1. No Warranty or Accountability

When you use ChatGPT or a free online template, you are relying on a tool that does not guarantee accuracy or take responsibility for the outcome. If the contract leads to a lawsuit, you will not get help from the platform that wrote it.

In contrast, a professionally prepared contract often comes with review, revisions, and professional liability coverage. That difference matters when you are signing deals worth tens or hundreds of thousands of dollars.

  1. Courts Will Not Give You a Pass for Using AI

Florida courts do not make exceptions for bad contracts just because you drafted them using ChatGPT. If a contract is vague, one-sided, or missing key elements, it can be interpreted against the drafter. That risk grows when you are working off a template or generative AI output with no legal review.
